Beginning October 1, 2006...
A Virginia Storm Water Management Permit (VSMP) is required under any of the following
circumstances:
When a land disturbing activity is regulated by §10.1-603.8 of the Code of Virginia and:
- When the area of land disturbance exceeds one (1) acre.
- When the location of the land disturbance is on a lot, which is part of a subdivision,
regardless of the amount of area being disturbed.
- Generally, the number of VSMP in a subdivision will equal the number of lots plus one for the developer's work creating the subdivision.
- The developer's VSMP would not be required if no land is being disturbed when creating the subdivision, i.e. - no roads or common areas.
- If a contractor/developer purchases or applies for building permits for multiple, contiguous lots in the same subdivision, DCR will allow that contractor/developer to obtain one (1) VSMP for all of the combined lots.
- A VSMP does not replace or negate the requirement for either a Land Disturbing Permit or an Agreement in Lieu waiver.
